NOTICE OF PASSING OF A ZONING BY-LAW AMENDMENT

TAKE NOTICE THAT the Council of the Corporation of the Township of Minden Hills passed By-Law No. 25-103 on the 9th day of October, 2025, under the provisions of Section 34 of the Planning Act, RSO 1990, c. P. 13.
The lands subject to the amending by-law are located in Part Lot 12, Concession 1, in the Geographic Township of Anson, known municipally as 1051 Loggers Crossing Lane, as shown in the key map.
IN MAKING THEIR DECISION, Council received no submissions from members of the public for consideration regarding this application.
THE PURPOSE AND EFFECT: The subject property is zoned ‘Shoreline Residential (SR)’ and is located within the Waterfront designation of the Township’s Official Plan. The property owners are proposing to construct a one-storey detached garage with carport. Construction of the garage would result in increased lot coverages which would exceed the maximum permitted, as well as reduce an interior side yard setback. The Township Zoning By-law 06-10 permits a maximum total lot coverage of 15% and maximum accessory lot coverage of 5%. The minimum interior side yard setback for a one-storey garage is 2 metres. The proposed amendment would serve to rezone the property from ‘Shoreline Residential (SR)’ to ‘Shoreline Residential Exception (SR-E)’ to permit an increased total lot coverage of 16% and total accessory lot coverage of 8%, together with an interior side yard setback of 1 metre for a detached garage and carport.
AND TAKE NOTICE that an appeal to the Ontario Land Tribunal in respect to all or part of this Zoning By-law may be made by filing a notice of appeal with the Clerk of the Corporation of the Township of Minden Hills via the Ontario Land Tribunal e-file service at https://olt.gov.on.ca/e-file-service by selecting “Minden Hills (Township)” as the Approval Authority or by mail at 7 Milne Street P.O. Box 359, Minden, ON, K0M 2K0, no later than 4:30 p.m. the 5th day of November 2025. The filing of an appeal after 4:30 p.m., in person or electronically, will be deemed to have been received the next business day. First-time users will need to register for a My Ontario Account. The appeal fee of $1,100 can be paid online through e-file or by certified cheque/money order to the Minister of Finance, Province of Ontario. If you wish to appeal to the Ontario Land Tribunal (OLT) or request a fee reduction for an appeal, forms are available from the OLT website at www.olt.gov.on.ca.
A COPY of the amendment and any additional information relating to the Zoning By-law Amendment is available for inspection by contacting the undersigned.
No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
