NOTICE OF PASSING OF A ZONING BY-LAW AMENDMENT

 TAKE NOTICE THAT the Council of the Corporation of the Township of Minden Hills passed By-Law No. 25-97 on the 25th day of September, 2025, under the provisions of Section 34 of the Planning Act, RSO 1990, c. P. 13.

 The lands subject to the amending by-law are located in Part Lot 11, Concession 14, in the Geographic Township of Snowdon, known municipally as 1045 Carefree Drive, as shown in the key map.

IN MAKING THEIR DECISION, Council received six written submissions from members of the public regarding this application, all of which indicated support for the application. No further comments were received. 

THE PURPOSE AND EFFECT:

 The subject property is currently zoned ‘Shoreline Residential (SR)’ and is located within the Waterfront designation of the Township’s Official Plan. The subject property is currently developed in the form of a single detached dwelling and accessory structures. The application would permit an 84.7 sq. metre (912 sq. foot) two-storey addition to the existing non-complying dwelling which is located within 15 metres of the high-water mark of Canning Lake. The property owners are also proposing to demolish the existing 37.5 sq. metre (404 sq. foot) non-complying garage and rebuild a 67 sq. metre (720 sq. foot) new garage, in which will maintain a 17.8 metre setback to the high-water mark of Canning Lake.

The zoning by-law amendment rezones the property from ‘Shoreline Residential (SR)’ Zone to ‘Shoreline Residential Exception Eighty-Two (SR-82)’ Zone to permit the increased size of an existing non-complying dwelling and the demolition and reconstruction of an existing non-complying garage.

 AND TAKE NOTICE that an appeal to the Ontario Land Tribunal in respect to all or part of this Zoning By-law may be made by filing a notice of appeal with the Clerk of the Corporation of the Township of Minden Hills via the Ontario Land Tribunal e-file service at https://olt.gov.on.ca/e-file-service by selecting “Minden Hills (Township)” as the Approval Authority or by mail at 7 Milne Street P.O. Box 359, Minden, ON, K0M 2K0, no later than 4:30 p.m. the 26th day of October 2025. The filing of an appeal after 4:30 p.m., in person or electronically, will be deemed to have been received the next business day. First-time users will need to register for a My Ontario Account. If the e-file portal is down, you can submit your appeal to the Municipal Clerk at vbull@mindenhills.ca

 The appeal fee of $1,100 can be paid online through e-file or by certified cheque/money order to the Minister of Finance, Province of Ontario. If you wish to appeal to the Ontario Land Tribunal (OLT) or request a fee reduction for an appeal, forms are available from the OLT website at www.olt.gov.on.ca.

 A COPY of the amendment and any additional information relating to the Zoning By-law Amendment is available for inspection by contacting the undersigned.

 No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
