Please Note a Revision to the Last Date for Filing a Notice of Appeal for the Notice of the Adoption of Official Plan Amendment No. 17 (OPA 17) and Passing of a Zoning By-law Amendment

Please take Notice that the Council of the Corporation of the Township of Minden Hills has adopted OPA 17 by By-law 24-017 and further passed By-law 24-018 on February 8, 2024 under provisions of Sections 17, 21 and 34 of the Planning Act, RSO, c. P. 13. The amendments apply to the Township in its entirety; therefore, no key map has been provided.

Purpose and Effect: The amendments will introduce policies and provisions with respect to permitting additional dwelling units within certain land use zone categories. OPA 17 also clarifies shoreline setbacks for existing waterfront development and amended consent policies to align with the County of Haliburton (County) Official Plan. The zoning by-law amendment would also serve to revise various definitions, intended to provide clarity for implementation, as well as to introduce new provisions for decks, and amending existing provisions for sleeping cabins, home occupation and non-complying buildings and structures; as well as revisions for spelling or typographic errors. 

In Making Their Decision, Council considered all written and oral submissions received regarding this application. The effect of written and oral submissions included revisions for minor spelling or grammatical errors, removing unclear technical terminology and revising wording to provide greater clarity for interpreting proposed provisions.

A copy of the amendment and any additional information relating to the Amendments is available for inspection by contacting the undersigned.

And take notice that any person or agency may appeal to the Ontario Land Tribunal in respect of the Zoning By-law Amendment (By-law 24-018) by filing, no later than 4:30 PM on the 19th day of March, 2024, a notice of appeal with the Clerk of the Corporation of the Township of Minden Hills, which must set out the reasons for the appeal and must be accompanied by the prescribed fee of $1,100.00 payable to the Minister of Finance by certified cheque or money order. The Tribunal may reduce appeal fees to $400.00 for eligible private citizens and community groups. A request for reduced fees must be made at the time of filing the appeal. The appeal must also be accompanied by the completed Ontario Land Tribunal (OLT) appeal form. If you wish to appeal to the OLT, a copy of an appeal form is available from the OLT website at www.olt.gov.on.ca or by contacting the Township Office.

Only individuals, corporations and public bodies may appeal a by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.

And take further notice that in accordance with Section 17 of the Planning Act, the County is the approval authority of OPA 17. The adopted amendment requires approval by the County prior to coming into full force and effect. Those portions of the Zoning By-law Amendment which are impacted by OPA 17 will only come into effect upon County approval.
