NOTICE OF PASSING OF A ZONING BY-LAW AMENDMENT

Take Notice That the Council of the Corporation of the Township of Minden Hills passed By-Law No. 26-29 and By-law No. 26-30 on the 12th day of March, 2026, under the provisions of Section 34 of the Planning Act, RSO 1990, c. P. 13.

In Making Their Decision, Council considered all oral and written submissions regarding this application, and which did not affect the amendment as approved.

Part Lot 3, Concession A, Anson, 101 Bobcaygeon Road (PLZBA2026006 – Whitney Plastics) By-law No. 26-29

The lands subject to the amending by-law are located in Part Lot 3, Concession A, Geographic Township of Anson, and municipally known as 101 Bobcaygeon Road, as shown in the key map

The Purpose and Effect: The subject property is currently zoned ‘Village Commercial (C4)’ and is located within the Downtown designation of the Township’s Official Plan Schedule ‘A-1’. The proposed amendment serves to rezone the property from ‘Village Commercial (C4)’ Zone to a site specific ‘‘Village Commercial Exception Five (C4-5)’ Zone in order to permit the conversion of a commercial unit, having no direct street frontage, into a residential dwelling unit. 

Part Lot 22, Concession 13, Snowdon, 1498 Ritchie Falls Road (PLZBA2026008 – Langdon & Jamal) By-law No. 26-30

The lands subject to the amending by-law are located in Part Lot 22, Concession 13, Geographic Township of Snowdon, and municipally known as 1498 Ritchie Falls Road, as shown in the key map. 

The Purpose and Effect: The subject property is currently zoned ‘Rural (RU)’ and ‘Hazard Lands (HZ)’ and is located within the Rural and Environmental Protection designation of the Township’s Official Plan. Application PLZBA2026008 was submitted to fulfill a condition of consent application H-018-25, which will facilitate the creation of a new residential building lot. An Environmental Impact Study (EIS) was prepared in relation to the consent application and identified both wetland and watercourse features. In recognition of the findings of the EIS, the zoning by-law amendment serves to rezone portions of the property that are not impacted by existing natural features from ‘Hazard Land (HZ)’ zone to ‘Rural (RU)’ zone. The amendment also serves to appropriately rezone any wetland or watercourse feature and the associated vegetated buffer as ‘Hazard Land (HZ)’ and further to rezone the balance of the severed parcel from ‘Rural (RU)’ to ‘Rural Residential Exception Twenty (RR-20)’ zone, to recognize site-specific provisions.

And Take Notice that an appeal to the Ontario Land Tribunal in respect to all or part of this Zoning By-law may be made by filing a notice of appeal with the Clerk of the Corporation of the Township of Minden Hills either via the Ontario Land Tribunal e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service by selecting the Corporation of the Township of Minden Hills as the Approval Authority or at the mailing address provided below no later than 4:30 p.m. on April 8th, 2026. The filing of an appeal after 4:30 p.m., in person or electronically, will be deemed to have been received the next business day. The appeal fee of $1,100 can be paid online through e-file or by certified cheque/money order to the Minister of Finance, Province of Ontario. If you wish to appeal to the Ontario Land Tribunal (OLT) or request a fee reduction for an appeal, forms are available from the OLT website at www.olt.gov.on.ca. If the e-file portal is down, you can submit your appeal to Amanda Dougherty, Manager of Planning email.  

A Copy of the amendment and any additional information relating to the Zoning By-law Amendment is available for inspection by contacting the undersigned.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
